Definitions
Buyer - any party entering into a sales contract with the store located at the URL www.ohes.pl.
Consumer - a consumer according to the regulations of the Civil Law Code.
Terms and Conditions - these terms and conditions, available at www.ohes.pl/strona/regulamin-sklepu
Store - the online store located at the URL www.ohes.pl belonging to the Seller

General provisions
1. Store address and contact information:

2. These Terms and Conditions set out the rules for the operation of the Store. Each person should become familiar with its contents before using the Store.
3. Through the Store, the Seller sells new, manufactured in Poland clothing assortment.
4. Making purchases in the Store requires the Buyer:
- a device with Internet access,
- a standard web browser,
- having an active e-mail address.
The type and scope of the store's activities
1. Through the store, the Seller sells an assortment of clothing from a distance and via Internet networks.
2. The assortment in the store is new, manufactured in Poland.
Rules for making purchases
1. The prices of all products in the Store's assortment are given in Polish zlotys or euros, depending on the Buyer's preference, and include VAT.
2. The delivery price should be added to the prices listed next to the product. Its amount depends on the method of delivery chosen by the Buyer during the purchase. The amounts are presented upon completing the order via the Store as well as in the "Delivery and payment" tab.
3. Making a purchase of a Product does not require registration in the Store.
4. Before the Buyer makes a purchase in the Store, the following information are presented to him:
- description and photos of the selected product
- the order summary amount, which includes the price of the clothes (including VAT) and the delivery charge for the purchase.
- available methods of payment and delivery
- delivery date of the product
5. Placing an order is done through:
- Selecting the parameters of the product/products, and then selecting "Add to cart" and "Order".
- After moving to the shopping cart tab - filling in the necessary data to enable the Seller to perform his obligations under the sales contract.
- Approve the store terms and conditions by checking the box for acceptance of the Terms and Conditions. The Buyer accepts the Terms and Conditions only if he has read and actually accepts its contents; acceptance of the Terms and Conditions is voluntary, but necessary to place an order.
- Expressing the will to conclude a sales contract by selecting "I buy and pay".
- Paying for the products according to the payment method selected by the Buyer.
6. Each time after the conclusion of the Agreement, a confirmation of acceptance of the order concerned is sent to the e-mail address provided by the Buyer when placing the order. The confirmation is sent automatically.
7. After the Store confirms the acceptance of the order and after the payment from the Buyer is booked, the placed order is transferred for processing.
8. Processing time of an order takes up to 3 days from the moment the amount indicated at the order summary in the "Basket" tab is booked by the Seller. If the Buyer has chosen the method of payment in the form of a direct transfer to the Seller's bank account, he is obliged to pay for the order within 2 days from the conclusion of the contract.
9. If the Buyer has chosen a form of cash on delivery payment, the order processing time (up to 3 days) is calculated from the conclusion of the contract.
10. The online payment service provider is Blue Media S.A.
11. The following forms of payment are available in the store:
- transfer to the Seller's bank account,
- payment through Blue Media S.A. service,
- payment through payment cards such as Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro,
12. Shipping is realized in the manner selected by the Buyer. Shipping costs are specified in the "Delivery and payment" tab. The delivery time of the order to the Buyer depends on the shipping method selected by the Buyer and is calculated from the day of order processing.
13. A VAT invoice confirming the purchase is sent with the order, which is sent electronically to the e-mail address provided when placing the order. The buyer is obliged to provide full details necessary for proper issuance of a VAT invoice:
- name/company;
- residence/site address;
- NIP number (for companies),
- mailing address.
14. If there is any doubt about the accuracy of the data provided during the ordering process, the Store has the right to withhold acceptance of the order until the situation is immediately clarified with the Buyer.
15. The store will immediately inform the Buyer in a situation where the product ordered by the Buyer is unavailable and return the funds received. The Seller shall refund the payment using the same method of payment used by the Buyer, unless the Buyer has expressly agreed to a different method of refund that does not incur any costs for him.
16. Each Buyer making an order agrees to receive at the email address provided by him information related to the progress of the transaction and notifications of changes to these Terms and Conditions.
Returns
1. In accordance with the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2014, item 827), a Buyer who is a Consumer who has concluded a remote agreement has the right to withdraw from the concluded agreement without providing a reason within 14 days from the date of issue of the item, i.e. from the moment when the Consumer took possession of the item, or when a third party indicated by the Consumer took possession of the item. To maintain the fourteen-day period referred to in paragraph 1, it is sufficient to send a statement of withdrawal before its expiration.
2. In case of withdrawal from the contract, the Consumer is obliged to return the goods by sending them to the address: 35/69 Świętokrzyska Street, 00-049 Warsaw or to InPost parcel machine to the address: 5 Próżna St., 00-107 Warsaw ( WAW287M) no later than 14 days from the day on which he/she withdrew from the contract. The returned goods should be packed in a way that prevents them from being damaged in transit.
3. In the case of returning the product, the return delivery costs shall be paid by the Consumer.
4. If the product is returned, the Consumer shall be refunded all payments received from him, including the cost of shipping the product to him no later than 7 days after the Seller receives the returned product.
5. The Seller shall refund the payment using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to a different method of refund that does not involve any costs for him.
6. If the Consumer has withdrawn from only a part of the contract, i.e. returns only a part of the items covered by one contract, the cost of delivering the item to the Consumer is not refunded by the Shop.
Claims
1. The clothes on sale are new, made in Poland and free of defects.
2. The Seller is responsible to the Buyer if the sold product has a physical or legal defect (warranty for defects). If a product with a defect is received, the Consumer has the right to file a complaint based on the provisions of the Civil Code.
3. If the sold product has a defect, the Consumer may demand that the product be replaced with a defect-free one or make a declaration of withdrawal from the contract.
4. In order to make a claim, please follow the instructions contained in the Shop under "Returns and complaints".
5. It is recommended to include in the claim, among other things, a brief description of the defect, the circumstances (including the date) of its occurrence, the data of the Consumer making the claim, and the Consumer's demand in connection with the defect of the goods.
6. The Consumer is obliged to attach to the claim the proof of purchase of the goods subject to complaint.
7. The Shop shall respond to the complaint request immediately, no later than within 14 days.
8. The products sent back under the claim procedure should be sent to the following mailing address: 35/69 Świętokrzyska Street, 00-049 Warsaw or to the InPost parcel machine located at: 5 Próżna St., 00-107 Warsaw (WAW287M).
Privacy and cookies policy
1. The rules regarding the processing of personal data and cookies are outlined at www.ohes.pl/privacy-policy-and-cookies/.
Final provisions
1. The Seller reserves the right to change the offers and prices found in the Store without affecting the Buyer's acquired rights, including, in particular, the terms and conditions of contracts concluded before the change.
2. In matters not covered by these Regulations, the provisions of Polish law, including in particular the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2014 item . 827 of June 24, 2014) and the Civil Code shall apply.
3. These Regulations are effective as of 26.07.2021.
